GRADE I TRAFFIC WORKS, 4-YEAR WARRANTY

Minister of Transport Dinh La Thang has just signed Decision 2920 on increasing warranty responsibility for road traffic infrastructure construction projects which are invested by the Ministry of Transport.

The subjects of application of this decision include investors, corporations assigned to act as investors, project management units, contractors, units managing, exploiting, and using the works, and other organizations and individuals related to the performance of warranty obligations for road transportation infrastructure construction projects under investment decisions of the Ministry of Transport...

According to this decision, for projects of special grade and grade, I will have a warranty period of 48 months, the guarantee amount is 3% of the contract value. Class II works will have a warranty period of 42 months, the guarantee amount is 5% of the contract value. With the works for the remaining levels, the warranty period is 24 months, the warranty amount is 5% of the contract value.

During the project warranty period, the construction contractors are responsible for urgently repairing and completely overcoming damage and defects caused by the contractors’ fault within 21 days from the date of receipt of the investor and project management unit's warranty request. The contractor must bear all costs related to the warranty. During this period, if the contractor does not carry out the warranty, or delays in the implementation, the investor and project management unit has the right to use the warranty guarantee money to sign contracts with other units to perform repair and remedy.

This Decision replaces Decision No. 3230 dated 25th August 2014 of the Minister of Transport, promulgating temporary regulations on enhancing warranty liability for road transport infrastructure construction projects under the Ministry of Transport investment decision.
